Inheritance Law for Property Owners

Understanding Israeli inheritance law is essential for property investors, especially foreigners. Israel's Succession Law (1965) governs how property is transferred upon death. Unlike many countries, Israel has no estate tax or inheritance tax — a significant advantage for property investors building generational wealth.

However, proper estate planning is crucial. Without a valid will recognized in Israel, the Succession Law dictates distribution: a spouse typically receives the apartment and half of other assets, with the remainder divided among children. For foreign investors, conflicts between home-country succession laws and Israeli law can create complications that advance planning prevents.

Key Legal Considerations

Wills in Israel: Four types of wills are recognized — handwritten, witnessed, before an authority, and oral (deathbed). A will executed abroad may be valid but should be reviewed by an Israeli lawyer to ensure enforceability.

Probate Process: Heirs must obtain either a Probate Order (with a will) or an Inheritance Order (without a will) from the Registrar of Inheritance or Family Court. Property title cannot be transferred without this order.

Joint Ownership: Married couples often hold property jointly. Understanding the implications of joint versus separate ownership is important for succession planning.

Foreign Heirs: Non-resident heirs can inherit Israeli property but may face tax implications in their home country. Advance planning with cross-border expertise is recommended.

Estate Planning Strategies

Smart estate planning can simplify future transfers: executing a bilingual (Hebrew + home language) will covering Israeli assets, designating beneficiaries clearly to avoid family disputes, considering a mutual will for couples, and consulting with both Israeli and home-country legal advisors. Points to consider

  • Cross-border complexities for foreign investors

  • probate can be slow without proper planning

  • potential family disputes

Does Israel have inheritance tax?

No. Israel abolished inheritance tax in 1981. There is no estate tax on property transferred to heirs. However, if heirs later sell the property, they may owe capital gains tax (Mas Shevach) calculated from the original purchase price.

Do I need an Israeli will for my property?

While not strictly required (foreign wills can be recognized), having an Israeli will specifically for your Israeli assets is strongly recommended. It simplifies the probate process, reduces delays, and avoids potential conflicts between jurisdictions.

How long does probate take in Israel?

With a clear will and no disputes, the probate process typically takes 3-6 months. Without a will or with disputes among heirs, it can take 1-3 years or longer. Having a valid Israeli will significantly streamlines the process.
